The purpose of these general conditions of sale and use is to govern the relationship between:
The company Oxan S.A. - QoQi.ch, Chemin de Longeraie 103, 1052 Le Mont-sur-Lausanne, publisher of www.qoqi.ch, and the Internet user having accepted the general conditions by becoming a member of QoQi.ch.
About these General Conditions
In these general conditions, the terms "we" and "our" refer to Oxan S.A. and the term "you" refers to the customer.
Acceptance of conditions
At the time of ordering, the customer acknowledges having read the conditions set out above, and declares that he accepts them without reservation. These conditions of use govern the contractual relations between Oxan S.A. and its client, both parties accepting them without reservation.
Ordered
By ordering, you certify that you are 18 years of age or over.
A firm order is placed when the customer presses the "Place order" button on the confirmation page.
Oxan S.A. reserves the right to accept or reject your order at our discretion. We reserve the right to cancel any order from a customer with whom there is a dispute over payment or any other matter.
You will receive an order confirmation at the e-mail address you provided when registering on the site. This confirmation is effective the moment you receive the email from Oxan S.A .. This email establishes a sales contract between you and Oxan S.A ..
payment methods
Credit card
You can pay for your purchases by VISA and MasterCard
Payment by credit card is secure and is made through the SIX organization and the PostiFinance bank. QoQi.ch does not have access to your payment data which is encrypted. For more discretion, the transaction will be called "Oxan S.A." on your card statement.
PostFinance (PostFinance Card or E-Finance) - Switzerland only
Pay for your order with your PostFinance Card or directly with your e-finance login.
PayPal - Switzerland only
Pay for your order with your PayPal account. Your transaction is secure thanks to the PayPal system and your financial information is never communicated to the merchant. For greater discretion, the transaction will be named PayPal Oxan S.A. on your statement.
TWINT - Switzerland only
TWINT is a Swiss digital wallet system that works with a smartphone app (iOS or Android). TWINT does not require a credit or debit card and works with any postal or bank account. Install the TWINT app, connect your postal or bank account or just load money, then pay with your smartphone.
Deliveries, deadlines and shipping costs
In the event of an error in the wording of the recipient's contact details, Oxan S.A. cannot be held responsible for the impossibility in which it may be to deliver the product (s) ordered.
Deliveries to Switzerland
Shipping costs are free for all orders of CHF 25.00 and over delivered in Switzerland. A contribution of CHF 4.50 will be required for orders with an amount less than CHF 25.00.
Delivery times are generally 2 to 3 working days and never exceed a week when the items are in stock. When the items are being restocked, the time is determined by the availability of the product (s) from distributors / manufacturers. The status of the item and the delivery time are then clearly indicated on the product sheet. Items being restocked are usually delivered within 2 weeks. If there is any problem relating to the availability of the item or its transit time, we will contact you personally to inform you of the situation.
These deadlines are however indicative and are not guaranteed. The customer can at any time request by e-mail an estimate of the delivery time of his order.
Oxan S.A. cannot be held responsible for any delay in delivery resulting from an error or delay by the delivery provider. A delay in delivery resulting from an error or a delay of the delivery provider does not give the right to any compensation or refund and does not allow the cancellation of an order free of charge.
Deliveries outside Switzerland
Shipping costs are free for all orders of 100.- and more delivered outside Switzerland.
For orders outside Switzerland where the amount is less than CHF100.00, the contribution to shipping and packaging costs will vary depending on the country.
Participation of CHF 9.00 for the following countries: Germany, Andorra, Austria, Belgium, Bulgaria, Denmark, Spain, Finland, mainland France
Aquitaine, Ireland, Italy, Luxembourg, Monaco, Netherlands, Portugal, Sweden.
The contribution to the shipping and packaging costs amounts to CHF 18.00 for the following countries: Canada, Cyprus, Croatia, Estonia, United States of America, Gibraltar, Greece, Guernsey, Hungary, Isle of Man, Islands Faroe Islands, Iceland, Jersey, Latvia, Lithuania, Malta, Mexico, Norway, Poland, Czech Republic, Romania, San Marino, Slovakia, Slovenia, Turkey.
Orders shipped outside Switzerland are invoiced free of tax. When going through customs and according to the customs legislation of your country, the VAT of the country of destination may be invoiced to you with customs fees.
For delivery times outside Switzerland, it is generally necessary to add 1 week to 10 days more to the delivery time in Switzerland.
Discretion and confidentiality
Our packages are discreet and do not mention our site QoQi.ch.
The name of the sender is "Oxan S.A.". The contents of the package as well as the delivery slip are not visible. For overseas deliveries that require a customs description of the contents, the terms are chosen with great care to protect your privacy.
Your personal data is treated confidentially and will never be communicated to third parties. Your postal address will under no circumstances be used for advertising mailings.
Products
The images and / or photographs illustrating the products offered on QoQi.ch do not enter into the contractual field. If errors occur, in no case the responsibility of Oxan S.A. can be engaged. In particular, depending on the color adjustments made, the colors of the products may differ from the actual products. Technical information and links are provided for informational purposes only. The technical specifications and / or the content of the delivered products may also differ from the data provided by the manufacturers or displayed on the Internet.
The prices
The price invoiced to the customer is the price indicated on the order confirmation on which any costs and any discounts are displayed. The prices listed on the order confirmation are binding.
Swiss VAT is included in our prices. For shipments abroad, our deliveries are based on the display of prices in Swiss francs "HT" (excluding taxes). In the event of delivery abroad, therefore, we do not charge VAT, but if the package is checked by customs you will have to pay the VAT of your country (country where the package is sent) and any customs fees.
Retention of title
Oxan S.A. remains the owner of all goods delivered until full payment of the related invoice.
Damage during delivery and delivery errors
Any transport damage (eg a damaged package) must be notified immediately to the carrier when the latter makes the delivery, failing which the customer assumes responsibility for any damage to the goods.
Any merchandise delivered in error or in excess must be returned immediately, or at the latest within 7 days. In the event of no return, the goods will be invoiced.
Withdrawal period
Oxan SA grants a withdrawal period of 14 calendar days from the date of delivery of the products and undertakes to take them back, provided that they are neither damaged nor opened, and are still in their original packaging ( control labels intact, not peeled / torn / cut, etc.).
For any return of merchandise or cancellation of an order, administrative costs apply. These costs amount to 10% of the selling price of the returned product (s). These fees cover administrative and logistical costs. Shipping and return costs are also the responsibility of the customer.
The right of withdrawal does not apply to contracts relating to the supply of products abroad (deliveries made outside Switzerland) as well as to all products in the "Lingerie" category and all cosmetic-type products ( lubricants, creams, cleansers, etc.)
For any withdrawal, a return request is mandatory (see below).
Returns
For any return related to a delivery error, a defective product, etc. a return request is mandatory. All return requests must be made by e-mail to info@qoqi.ch.
Defective and warranty products will in all cases be replaced by a new and identical product, unless the product in question is no longer available, in which case a credit note or a replacement item will be offered to the customer.
The return costs remain, in all cases, the responsibility of the customer.
Guarantee
The electrical or electronic products offered on QoQi.ch are
covered by a 2-year manufacturer's warranty from the date of delivery. Other products are not covered by any warranty. In the event of repair or exchange of a defective product, an extension of the warranty or a renewal of the warranty period is excluded.
Our responsibility
These "General Conditions" determine all of our obligations and responsibilities.
We are not bound by any other warranty, condition or other provision, except those expressly mentioned in this contract.
Any guarantee, obligation or other provision concerning the products or services which could be implied or incorporated in this contract by the law, the jurisprudence or in any other way (including but without limitation any implied condition as to the quality , fitness for any purpose and any duty of care) are expressly excluded by this provision. In particular, QoQi.ch is not responsible for guaranteeing that the products are suitable for the use for which you intend them.
Our liability under this contract cannot be incurred neither for any loss of income, loss of profits, loss of contracts, loss of data nor for any indirect or consequential loss or damage of any kind whatsoever resulting or caused by a damaging act (including negligence) or for any other cause may in no case exceed the amount for which you owe us for the products or services in question.
We cannot be held responsible for any loss or damage you may suffer which results from our delay in performing any of our obligations or from our failure to comply with all or part of our obligations under the contract, where 'such delay or failure is due to a circumstance outside our control. In the event of delay, we will perform our obligations as soon as possible.
Oxan S.A. cannot be held responsible for any damage of any kind, whether material, immaterial or bodily, which could result from a malfunction or from the improper use of the products sold. It is the same for the possible modifications of the products resulting from the manufacturers. The responsibility of Oxan S.A. will, in any event, be limited to the amount of the order and cannot be blamed for simple errors or omissions which may have remained despite all the precautions taken in the presentation of the products.

Disputes
This contract is subject to Swiss law. In the event of a dispute, Oxan S.A. reserves the right to choose the court to seize.

For all other cases not governed by these conditions of sale, the Swiss Code of Obligations applies.
